Navigating the alphabet soup of laws and benefit policies related to accommodating an employee's disability and managing leaves of absence (i.e.: ADA, FMLA, PDA, STD, LTD) is a persistently challenging area for many HR professionals. Those challenges have increased as a result of new EEOC guidance, the Supreme Court's decision in Young v. United Parcel Service, Inc., and new state and local laws imposing enhanced obligations with regard to accommodation of conditions related to pregnancy and childbirth.

This presentation will review the latest legal developments with regard to accommodations and leaves of absence, and will answer your questions about how to respond to an employee's request for a reasonable accommodation including:

  • Protocols to receive accommodation requests;
  • Understanding when an employee may be entitled to accommodation;
  • The "undue hardship" exception;
  • When and how to incorporate managers in the interactive process;
  • Leaves of absence under the FMLA and as a reasonable accommodation;
  • Notices and documentation; and
  • The interrelationship with short-term and long-term disability policies.
Presenters Bio:

Tracey I. Levy is the founding member of Levy Employment Law, LLC. She leverages more than 20 years of experience as outside employment counsel and in-house as an employee relations specialist to guide managers and HR professionals through the full employee life-cycle, providing practical advice on workplace-related issues such as requests for accommodation and leaves of absence. She is also an adjunct instructor with Cornell University ILR School’s Human Capital Development program in Manhattan. Tracey holds an advanced law degree from Yale Law School’s LLM program, a JD from Albany Law School and a BA from Union College.
